Terms and Conditions of Sale

1. Object and Identification

These terms of sale define the contractual relationship between Casa Frida and the buyer, as well as the conditions applicable to any purchase made through the www.casa-frida.com website.

The site is operated by Casa Frida, whose head office is located in Pibrac (31820), France, registered with the Toulouse Trade Register under number 538 206 004.

2. Products and Craftsmanship

The products offered are those listed in the catalog published on the site.

Handmade Specificity: The Client is informed that the products sold are Mexican handicrafts (handmade). The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered. Handmade manufacturing implies minimal differences from one product to another (shade, slight paint irregularities, exact dimensions) which cannot be considered as defects, but as a mark of their authenticity.

3. Prices

The prices listed in the catalog are in Euros (€). VAT not applicable, art. 293B of the French CGI.
Casa Frida reserves the right to modify its prices at any time. Prices do not include shipping costs.

4. Orders and Payment

Payment is due upon ordering. Payments can be made by:

• Credit Card: via a secure system using SSL protocol (your data is encrypted).
• PayPal.
• Bank Transfer.

Retention of title: The products remain the property of Casa Frida until full payment of the price.

5. Delivery

Deliveries are made to the address indicated on the order form. Risks are borne by the purchaser from the moment the latter has taken physical possession of the goods. In case of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.

6. Withdrawal and Exceptions (Oilcloths)

In accordance with current regulations, the buyer has a period of 14 days to exercise their right of withdrawal from the receipt of their order, without having to justify reasons or pay penalties, except for return costs.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL:

The right of withdrawal CANNOT be exercised for:

• Products made to the consumer's specifications or clearly personalized, in particular OILCLOTHS sold by the meter (cut-to-measure). Once the cloth is cut to your request, it will not be returned or exchanged.
• Products unsealed by the customer which cannot be returned for hygiene reasons (e.g., worn earrings).

For other eligible items, the return must be made in their original condition to the address in Plaisance-du-Touch indicated in Article 1.

7. Legal Warranties

All products supplied benefit from the legal guarantee of conformity and the guarantee against hidden defects under French Law.

In the event of proven non-conformity of a product (excluding artisan tolerance mentioned in Article 2), it may be returned to Casa Frida for exchange or refund. All claims must be made by post or email within 30 days of delivery.

8. Personal Data

Casa Frida undertakes not to disclose to third parties the information communicated by buyers. These are confidential and will only be used for the processing of your order.

9. Settlement of Disputes

These online terms of sale are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action.
